Nikhil Desai was a trainer at the Young ICCA Skills Training Workshop which was held at the Laico Regency Hotel in Nairobi Kenya. The theme of the workshop is the Basics of International Arbitration, focusing on two topics: “Initiating Arbitral Proceedings: How and Where to Start” and “Arbitration under Bilateral Investment Treaties: A Case Study of the Cortec Mining Kenya Limited & Others v. Republic of Kenya”. Nikhil focussed his training on the key considerations young practitioners should contemplate when commencing arbitration proceedings, including: interpreting the arbitration clause; the law of the arbitration agreement; the seat of the arbitration; tiered arbitration clauses; the Request for Arbitration; and the Response to the Request for Arbitration. Other trainers included: Professor Githu Muigai (former Attorney General of Kenya); Dr. Willy Mutunga (Retired Chief Justice and President of the Supreme Court of Kenya); Ms. Njeri Kariuki (Njeri Kariuki Advocate); Mr. Geoffrey Imende (Mohammed Muigai Advocates); Mr. Ken Melly (IKM Advocates); Ms. Mercy Okiro and Mr. Lee Mutunga (IMPETUS Law).
