Leah Njoroge-Kibe and Charles Kimani of JMiles & Co. contributed a research article to the I-Arb Africa blog. The article titled, A fly in the ointment: Investigating the non-payment of the advance on costs by parties in ICC arbitration proceedings, assesses from a substantive and procedural perspective, the challenges parties to ICC arbitration proceedings face where advance on costs fail to be paid by defaulting parties. This is against the background of real concerns that non-payment of the advance on costs is increasingly being used as a tactic by parties to delay the arbitration process or more drastically, render it ineffective.
